1. The stop
The first step in a DUI arrest is the traffic stop. Police officers might stop you for the following reasons:
- You arrive at a roadside safety check (DUI roadblock)
- They have probable cause or reasonably suspect you are under the influence
- You are operating your vehicle unusually
There are also situations in which an officer might stop you for other reasons. For example, a speeding stop could turn into a DUI arrest.
2. Observation and identification
The next step is observation. The officer would observe you and potentially develop a suspicion that you are under the influence. This step also involves collecting your license, vehicle registration and proof of insurance.
3. Testing
This is the most complex stage. Outcomes could depend on a combination of factors including the officers’ suspicions, your consent to testing procedures, the results of your tests, additional tests you might take, the validity of your driver’s license and other variables.
